1. Purpose
These terms of sale govern the sale of CyLimit physical products (collectible card packs) on physical.cylimit.com, between CYLIMIT, a French simplified joint-stock company (SAS) with a share capital of EUR 1,000, registered with the Paris Trade and Companies Register under no. 917 501 298, whose registered office is at 6 rue d'Armaillé, 75017 Paris, France, and any person making a purchase on the site.
2. Products
The products sold are sealed packs of collectible cycling cards. Each pack contains 10 cards in the 63 x 88 mm format. The content of each pack is randomized: the visuals shown on the site illustrate the range without indicating the cards actually contained in a given pack. Physical cards are collectibles and grant no rights in the CyLimit online game.
3. Prices
Prices are shown in euros, all taxes included for deliveries within the European Union. Shipping costs are calculated and displayed at checkout, before the order is confirmed. Depending on the destination, including within the European Union, local import taxes or fees may remain payable by the customer, as the products are shipped from abroad.
4. Order and payment
Orders are placed through our secure checkout. Payment is due immediately and can be made by card or Apple Pay. The order is confirmed by email once the payment is validated. CyLimit reserves the right to refuse an order in case of a previous dispute or suspected fraud.
5. Preparation and shipping
Packs are shipped from our stock, with a tracking number. The delivery time depends on the shipping option chosen and is shown at the time of purchase. The applicable delivery deadline is the one stated at the time of the order. If it is exceeded, the customer may require CyLimit to deliver within a reasonable additional period and, failing that, cancel the order and obtain a refund.
6. Right of withdrawal
In accordance with articles L221-18 and following of the French Consumer Code, the customer has 14 days from delivery to withdraw, without giving any reason. The right of withdrawal applies only to packs whose seal is intact, as the randomized content makes the product inseparable from its seal. Return costs are borne by the customer. The refund is issued within 14 days of receiving the return.
7. Damaged or non-compliant products
If a pack arrives damaged, defective or if the order is incorrect, the customer contacts CyLimit at [email protected] as soon as possible, ideally within 7 days of delivery, with photos of the pack concerned and of the shipping packaging. CyLimit will replace the pack with an equivalent sealed pack or, if replacement is impossible, issue a refund. CyLimit may request the return of the damaged pack, at its own expense, before sending the replacement. These provisions apply without prejudice to the legal guarantee of conformity.
8. Liability
CyLimit cannot be held liable for delays or failures caused by force majeure, by the customer or by the unforeseeable and insurmountable act of a third party. The products are collectibles intended for people aged 6 and over; the cards are not toys for young children.
9. Personal data
Data collected as part of orders is processed in accordance with our privacy policy, available on the site.
10. Applicable law and disputes
These terms are governed by French law. In case of a dispute, the customer may use, free of charge, the consumer mediator CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net), subject to a prior written complaint sent to CyLimit less than one year before, or the European online dispute resolution platform. Failing an amicable resolution, French courts have jurisdiction.
